How Is Compensation Calculated?

Before you make a compensation claim it can help to understand how a settlement or payout is calculated.

 

As a general rule, compensation is split into two heads of claim: general damages and special damages.

 

General damages are intended to compensate you for your physical and psychological injuries, as well as the impact they’ve had on your life. The more serious the injury, the higher the payout.

 

Special damages relate to the financial impact your injuries have had. For example, you may have been unable to work for a month and lost out on salary. It’s possible to claim back costs like this when you claim. Just remember to keep hold of all your receipts and bills. 

 

You don’t always have to claim for special damages if there are no financial losses. To make a personal injury claim, however, you need to have suffered some form of injury.

What Is A No Win No Fee Agreement?

A No Win No Fee agreement is a type of contract that is often used in compensation claims for injury or illness. 

 

As the same suggests, you don’t need to pay your solicitor any fees if they fail to succeed in your case. 

 

You only pay a fee to your solicitor if you receive compensation. This is to cover the costs of representing you. The amount you pay is capped by law at 25%, meaning you’ll take away the vast majority of your compensation.

To claim compensation, you must take legal action within the time periods set out in the Limitation Act 1980. If no action is taken within the time frame, you may be prevented from claiming.

 

For personal injury claims and most medical negligence claims, the time limit is 3 years from the date of the accident or incident. 

 

In some cases of medical negligence, the time limit may run from the point in time at which you learned that the problems you have were caused by negligence. This is called the "date of knowledge".

No, you do not pay tax on your compensation payout. The amount you receive is not taxable so the only fees you'll pay will be to your solicitor for representing you.

No, you do not need a solicitor in order to claim compensation. However, given the technical and complex nature of the claims process, it's always advised to at least get legal advice on your case. You could run the risk of losing your claim and potentially incurring costs, which can mount to thousands of pounds.
